Federal Investigation for Shipping Marijuana by Mail and Transporting Marijuana Across State Lines: Case Closed with No Criminal Charges or Prosecution
The U.S. Drug Enforcement Administration (DEA) investigated a Rhode Island man for crossing state lines with marijuana and then attempting to ship it using the mail system. The man went on a trip to Colorado. Marijuana can be legally purchased in that state.
The man took advantage of this opportunity buy purchasing a large quantity of marijuana and other related products. He then transported these products across state lines from Colorado and into Utah where he placed them into the mail utilizing Federal Express. Internal security measures of Federal Express detected the package as suspicious for containing unlawful narcotics.
Federal Express then notified local law enforcement authorities who contacted the DEA due to the interstate aspect of this package and its destination for Rhode Island. A DEA Agent assigned to the case tracked the man back to his home in Rhode Island and contacted him as part of an ongoing drug investigation. Fearful of the consequences for a potential criminal prosecution, the man retained Federal Defense Attorney, John L. Calcagni III, to represent him in this matter.
Attorney Calcagni made contact with the DEA Agent regarding the suspicious package. The agent sought consent to open the package and examine its contents. Attorney Calcagni entered into such an agreement in an effort to benefit his client. After several weeks of ongoing negotiations regarding the matter, Attorney Calcagni successfully persuaded the DEA Agent and federal authorities to close out this investigation again
