Conspiracy and Possession with Intent to Distribute 2 Kilograms of Cocaine: Probation
A Dominican man was arrested and charged with Conspiracy and Possession with Intent to Distribute 2 Kilograms of Cocaine. Police conducting surveillance observed two men, operating separate vehicles, drive up next to each along the roadside. One man got out of his vehicle and went into the other vehicle. After several minutes, he emerged carrying a Whole Foods shopping bag and returned to his own vehicle. The men then parted ways.
Police followed the men separately as they drove off. Police first conducted a motor vehicle stop of the man who received the shopping bag. A search of his car yielded the bag, which contained two kilograms of cocaine. The man found in possession of the drugs told police he received them from the other man. Police then stopped his vehicle.
Though no drugs or contraband were found in his vehicle, he was criminally charged for the cocaine, which police allege he provided to the man initially found in possession of the drugs. The Dominican man retained Rhode Island Criminal Defense Lawyer, John L. Calcagni III, to defend him in this matter. After filing a motion to suppress based upon his client’s arrest, subsequent pretrial negotiations and conferences, Attorney Calcagni secured his client’s release on bail and ultimately resolved this case with a sentence of probation.
