Possession of Heroin: Continued Without a Finding (CWOF)
A New Bedford man driving in the city was stopped by police for allegedly failing to use his directional signal. As police approached the driver’s side window, they observed a large knife protruding from the man’s pocket. Police instructed the man to exit the vehicle, seized the knife, conducted a pat frisk, and felt a knotted object consistent with the packaging of illegal narcotics. Police retrieved the knotted object, which was a plastic bag filled with heroin. Based on this discovery, police arrested and charged the man with possession of heroin.
The man retained Massachusetts Criminal Defense Lawyer, John L. Calcagni III, to defend him in this matter. After negotiating with the prosecutor at a pretrial conference, this matter was continued without a finding. This result allowed the man to avoid a criminal conviction. After one year, the case will be dismissed and eligible for sealing.
