Newport Disorderly Conduct: Dismissed
Newport Police were clearing the streets on New Year’s Eve after the bars let out. To disperse the crowds, police directed people away from the buildings and to keep moving up and down the sidewalks. One man, apparently intoxicated, refused to leave and threatened police by saying “I’ll kick your ass cracker.” He then attempted to punch one of the officers in the chest. The man’s actions immediately caught the attention of other police officers who rushed the man, took him to the ground, cuffed him and placed him under arrest. The man had been out celebrating with a group of friends. One of his friends noticed the man on the ground being tackled by police. However, this friend had not witnessed the man’s previous actions that led to his observed reaction by police. As the friend approached his friend to intervene, he too was tackled, cuffed and arrested. He was charged with disorderly conduct in Rhode Island District Court. He and his parents retained Rhode Island Disorderly Conduct Lawyer, John L Calcagni III, to defend him in this matter. Attorney Calcagni dispatched one of his investigators to interview multiple eyewitnesses to this incident, all of whom supported the friend’s innocence. He had not acted in a disorderly manner. Instead, he simply approached the scene out of concern for the man and was fully cooperative with police. Even the officers on scene acknowledged this fact in their reports. Moreover, the man was in the interviewing process to work for the Department of Homeland Security and the Transportation Security Administration. Attorney Calcagni relayed this information, to include the investigator’s report and witness statements, to the City of Newport Solicitor. Based upon these efforts, Attorney Calcagni successfully persuaded the solicitor to dismiss this case against his client. The matter has since been sealed from the man’s record.
