- Possession of with Intent to Access Child Pornography, in violation of 18 U.S.C. § 2252(a)(4)(B)
Case Overview:
Members of the Department of Homeland Security and the Rhode Island State Police Internet Crimes Against Children Task Force received a cyber tip from a social media site that one of its users was using the platform to store child pornography. The tip provided law enforcement authorities with the name, contact information, and user ID of the social media platform’s customer. Authorities used this information to identify the customer, locate his residence, and obtain a search warrant to search it for electronic devices and/or files related to child pornography crimes. Police encountered the customer who confessed to his wrongdoing. He also turned over his devices that contained videos and images of child pornography. This resulted in the man’s arrest and criminal charges in United States District Court for the District of Rhode Island for federal child pornography offenses. He retained Federal Criminal Defense Lawyer, John L. Calcagni III, to defend him in this matter.
Case Result:
Dismissed. After months of pretrial negotiations, Attorney Calcagni successfully struck a deal with federal prosecutors that resulted in the dismissal of all federal charges
