Woonsocket DUI 2nd Offense Case Result
Criminal Charges:
Man arrested by Woonsocket Police and charged in the Providence County Rhode Island District Court (6th Division) for:
- Driving Under the Influence – 2nd Offense, in violation of RIGL § 31-27-2 ;
- Operating on a Suspended License, in violation of RIGL § 31-11-18.1
Case Overview:
While on patrol, Woonsocket Police observed a vehicle with no headlights on and traveling at a high rate of speed. Police followed the vehicle and after observing several traffic violations, conducted a traffic stop. Police approached the vehicle and asked the male operator to step out to perform standardized field sobriety tests, which he agreed to do. The man failed the tests and was arrested for driving under the influence. His license was also suspended. Once back at the station, the man was asked to submit to a chemical test, which he did and failed. As such, police charged him with Driving Under the Influence – 2nd Offense and Operating on a Suspended License in Rhode Island District Court. He retained Rhode Island Criminal Defense Attorney, John L. Calcagni III, to defend him in this matter.
Case Result: 6-month suspended sentence.
Attorney Calcagni began to negotiate with the solicitor, discussing the man’s history of alcohol abuse and commitment to a substance abuse program. Because this was the man’s second offense within three years, he faced jail time. Attorney Calcagni persuaded the solicitor to agree to a 6-month suspended sentence with probation. This agreement allowed the man to seek continued treatment and avoid a jail sentence. The operating on a suspended license charge was ultimately dismissed.
