Three (3) Counts of Duty to Stop in Accident Resulting in Injury In Pawtucket, RI
Criminal Charges:
Man arrested in Pawtucket RI and charged in the Providence County Rhode Island District Court (6th Division) and Rhode Island Superior Court (Providence County) for:
- Three (3) counts of Duty to Stop in Accident Resulting in Injury in violation of RIGL § 31-26-1(b)
- Failure to Stop for Accident Resulting in Damage to Vehicle in violation of RIGL § 31-26-2
- Probation Violation
Case Overview:
Pawtucket Police responded to reports of a multi-vehicle accident involving injuries. Upon arrival, police observed three vehicles with heavy damage and several individuals who required medical attention. Police learned that the suspect vehicle involved had fled the scene but lost its license plate during the crash. Police ran the license plate which revealed the identity of a man who lived in Cranston and who owned a vehicle that met the description from the witnesses. Police put a BOLO out for the man’s vehicle which was subsequently found by North Providence Police. The man was arrested and transferred to Pawtucket Police where he was charged with three counts of Duty to Stop in Accident Resulting in Injury and Failure to Stop for Accident Resulting in Damage to Vehicle. He retained Rhode Island Criminal Defense Attorney, John L. Calcagni III, to defend him in this matter.
Case Result: Suspended Sentence with Probation.
Due to the man being a probation violator, he was held without bail pending an evidentiary probation violation hearing. Attorney Calcagni entered his appearance and immediately began negotiating with the State prosecutor to secure the man’s release on bail. After several pretrial conferences, Attorney Calcagni persuaded the prosecutor to wrap up the new case and the probation violation together as part of a global resolution. The resolution called for a 3-year suspended sentence in exchange for the man’s admission of guilt on the new charges. The man accepted the offer and closed out his cases, allowing him to avoid serving any further time in jail. He was released from custody that same day and readmitted to probation.
