Warwick RI Second-Degree Sexual Assault Child Molestation Case Result
Criminal Charges:
Man arrested in Warwick, Rhode Island, and charged in the Kent County Rhode Island Superior Court (Kent County) for:
- Second-Degree Sexual Assault Child Molestation, in violation of R.I.G.L. § 11-37-8.3
Case Overview:
Coventry Police investigated allegations of Second-Degree Child Molestation of a young female by her stepfather. The female participated in an interview with the child advocate where she articulated several instances of sexual abuse, to include being forced to watch her stepfather masturbate to pornographic films, and eventually forced to participate by touching his penis and him touching her breasts. Based on these disclosures, a warrant was issued for the stepfather’s arrest on charges of Second-Degree Child Molestation in Rhode Island Superior Court (Kent County). Once arrested and charged, the man retained Rhode Island Sex Assault Defense Lawyer, John L. Calcagni III, to defend him in this matter.
Case Result: Sex Assault Amended to Felony Assault with Suspended Sentence and Probation.
Attorney Calcagni ultimately negotiated a plea deal that provided for the man’s admission to the less serious, amended charge of felony assault as opposed to the charged sexual assault offense. This compromise disposition enabled the man to accept responsibility for a non-sex offense that did not require him to serve any time in jail or register as a sex offender. The man received a suspended jail sentence with probation and subsequently relocated out of Rhode Island.
