Providence Union Organizer’s Disorderly Conduct Case Result

Case Overview:
Pawtucket Police were called in to monitor the International Brotherhood of Teamsters Union picketing activities. The picket line formed outside of a company where management and the union could not agree upon terms of a new union contract. One of the union’s lead organizers, an out-of-state resident, was arrested three times for disorderly conduct for his alleged actions on the picket line. This allegedly involved shouting profanities and fighting words at police, obstructing the movement of officers on foot and inside police cars, and intimidating employees of the company being picketed who sought to cross the picket line. Dissatisfied with the legal representation offered to him by the union, the organizer retained Rhode Island Criminal Defense Lawyer, John L. Calcagni III, to defend him in three separate cases, each charging disorderly conduct, in Rhode Island District Court.
Case Result: 1-Year Filing.
Attorney Calcagni filed his appearance, conducted discovery, and set the matters down for trial after he was unable to reach a pretrial resolution with the prosecution. On the eve of trial, Attorney Calcagni successfully negotiated a disposition that called for the dismissal of two cases in their entirety, and as for the third, it was filed for one year. Providing the union organizer performs some community service and makes a small charitable contribution, the case will be eligible for expungement in 12 months. This disposition did not result in a criminal conviction.
