Road Rage Assault on Senior Leads to Deferred Sentence in Providence RI
Criminal Charges:
Middle-aged man charged in Rhode Island Superior Court (Providence County) for:
- Assault on a Person Over Age 60, in violation of R.I.G.L. § 11-5-10
Case Overview:
An elderly couple experienced a road rage incident with a middle-aged man. The incident began when the two vehicles were traveling with one behind the other, and eventually both vehicles turned into a parking lot and came to a stop. According to the elderly wife, her husband exited the car and walked over to the other vehicle. The middle-aged man stepped from his car and struck the husband in the face, causing him to fall backward onto the pavement and strike his head. The middle-aged man then fled the scene and the couple called Bristol Police. Officers located and identified the man from his vehicle registration. They then arrested the man and charged him in Rhode Island Superior Court with the felony offense of Assault on a Person Over Age 60. The man, who has a felony criminal history, retained Rhode Island Criminal Defense Lawyer, John L. Calcagni III, to defend him in this matter.
Case Result: Deferred Sentence.
Attorney Calcagni used the services of a private investigator to tail the man and collect photographic and videographic evidence of his activities to undermine his injury claims, and overall, his credibility. Attorney Calcagni also obtained video evidence of the altercation, which showed that his client struck the man a single time and not twice, as the victim alleged. Based on these overall efforts, Attorney Calcagni persuaded prosecutors to resolve this case with a disposition known under Rhode Island criminal procedure as a deferred sentence. Providing the defendant is not charged with a new offense within the next three years, he will be eligible to have the charge sealed or expunged from his record. The man will also not incur a criminal conviction and receive any criminal punishment as part of this disposition.
