Rhode Island Technician’s Bail Granted in Sexual Assault Allegation
Criminal Charges:
Ultrasound technician charged in the Kent County Rhode Island District Court (3rd Division) for:
- First-Degree Sexual Assault, in violation of RIGL § 11-37-2
Case Overview:
A male ultrasound technician was accused by a male patient of First-Degree Sexual Assault, which alleged sexual penetration by force. The technician is a Pakistani man who immigrated to the United States long ago and attained U.S. Citizenship. Though a trained medical doctor and radiologist in Pakistan, the man had worked as an ultrasound technician with a local medical group for more than 20 years. The patient accused the technician of digitally penetrating his anus and manually stimulating his penis during the ultrasound procedure. The technician fully cooperated with police and denied the patient’s claims. Notwithstanding, the technician was eventually arrested and charged by West Warwick Police with First-Degree Sexual Assault in Rhode Island District Court (3rd Division). At arraignment, the Court ordered that the technician be held without bail. His sons then retained Rhode Island Sex Assault Defense Lawyer, John L. Calcagni III, to defend him in this matter.
Case Result: Bail Granted.
The case proceeded to a bail hearing where Attorney Calcagni established that no one in the medical office at the time of the alleged assault, to include staff and patients, saw, heard, or suspected anything out of the ordinary. Attorney Calcagni also cross-examined the patient, highlighting age and physical discrepancies between him (younger and stronger) and the technician (elderly and in poor health). The cross-examination also exposed the complainant’s lack of verbal or physical resistance during the alleged event, his cooperation with repositioning his body during the alleged sexual encounter, inconsistencies in his statements, and his hiring a personal injury lawyer to seek money damages within days of the alleged event. Attorney Calcagni also called other employees of the medical group to impeach the patient and attest to the technician’s outstanding character. Based on Attorney Calcagni’s collective efforts, the man was released on bail.
