Warwick Reckless Driving Case Dismissed | Rhode Island Court Outcome
Criminal Charges:
Motorist charged in the Rhode Island District Court (3rd Division), Warwick, Kent County for:
- Reckless Driving, in violation of RIGL § 31-27-4 (1)
Case Overview:
Warwick Police performed a traffic stop of a vehicle observed to be operating at a high rate of speed and driving erratically. A police officer on patrol observed the Tesla make multiple lane changes without using a directional signal, weaving in and out of vehicles. Radar detection indicated that the vehicle was traveling over 60 mph when the flow of traffic was moving at approximately 30 mph. Police charged the motorist with Reckless Driving in Rhode island District Court (3rd Division) and several civil infractions in the Rhode Island Traffic Tribunal. The motorist was a candidate for a commercial pilot’s license and feared how a criminal conviction of any kind could adversely impact his candidacy. He hired Rhode Island Criminal Defense Lawyer, John L. Calcagni III, to defend him in this matter.
Case Result: Dismissed.
Attorney Calcagni identified discrepancies and a legal flaw in the police narrative which resulted in the criminal charge being dismissed. Attorney Calcagni and his team then negotiated a resolution of the traffic citations in a manner that did not adversely impact the man’s driving privileges.
