Suspended Sentence for Carrying Firearm Without License in Providence, RI
Criminal Charges:
Man charged in Rhode Island Superior Court (Providence County) for:
- Carrying a Firearm without a License, in violation of R.I.G.L. § 11-47-8 (a)
Case Overview:
While on routine patrol, Providence Police observed three individuals leaving a nightclub in a vehicle. Police initiated a motor vehicle stop due to illegally tinted windows. While speaking with the rear seat passenger, the officers noticed him to be nervous, not making eye contact and to be in possession of a satchel bag. The officers ordered the three men out. Upon patting down the rear seat passenger, police located a loaded firearm inside his satchel bag. After confirming that the man did not have a license to carry a firearm in Rhode Island, police seized the firearm and placed him under arrest for Carrying a Firearm without a License. The man was ultimately charged in Rhode Island Superior Court (Providence County). He hired Rhode Island Criminal Defense Lawyer, John L. Calcagni III, to defend him in this matter.
Case Result: Suspended Sentence.
Attorney Calcagni and his team worked quickly to submit a mitigation packet to prosecutors citing his lack of criminal history, age, stable home environment, and employment history. After many months of pretrial negotiations, he successfully persuaded prosecutors to resolve the case. In exchange for the man’s plea of nolo contendere, he received a suspended sentence, allowing him to avoid serving any jail time.
