First Degree Sexual Assault Charge Dismissed in Johnston RI
Criminal Charge:
A man charged in Rhode Island Superior Court (Providence County) for:
- First Degree Sexual Assault, in violation of RIGL § 11-37-2
Case Overview:
A young man and business owner met a Ukrainian woman online. They dated for a short period and then married in Las Vegas. Following the wedding, the couple settled in the man’s Johnston home. He owns and operates his own business. She had an unsteady work history. One day, the man discovered that his new wife was involved in online escorting and credit card fraud activity. He confronted her, which resulted in a domestic altercation. He then cancelled her mother’s trip to the United States, which he had financed, and demanded a divorce. The woman responded with a rape allegation, triggering the man’s arrest. He immediately retained Rhode Island Sex Assault Defense Lawyer, John L. Calcagni III, to represent him in this matter.
Case Result: Dismissed.
The Court ordered the man held without bail at arraignment because of the severity of the charges. Attorney Calcagni successfully secured his release on bail within a few weeks. Attorney Calcagni and his client also engaged the services of a private investigator to gather evidence on the woman’s illicit activities. This information was collected from various online sites, social media accounts, and a digital forensic extraction of the woman’s tablet. Once all this information was presented to the prosecution, there was much doubt cast on her claims. While the case was pending, the woman was also arrested in another jurisdiction for similar conduct and deported from the United States because of her lack of U.S. Citizenship or other status to lawfully remain in the country. Based on the totality of these circumstances, Attorney Calcagni and his team persuaded the prosecution to dismiss this case against the man.
