Case Overview:
Johnston Police responded for a report of a wellness check for a woman who was on the roadside with her vehicle. Upon speaking with the distraught woman, she informed officers that she and her adult daughter were involved in a physical altercation during which the girl bit her mother on the arm, breaking the skin and prompting the need for medical treatment. Police responded to the family home to inquire of the daughter. The young woman admitted she and her mother had a verbal altercation that turned physical when her mom placed her in a chokehold. The daughter admitted that she bit her mother in self-defense, and only as necessary, until the mother released the grip on her neck. Police perceived the mother to be the aggressor, prompting them to arrest and charge her with Domestic Simple Assault and Domestic Disorderly Conduct in Rhode Island District Court (3rd Division). She hired Rhode Island Criminal Defense Lawyer, John L. Calcagni III, to defend her in this matter.
Case Result: Dismissed.
The woman had no criminal record. Attorney Calcagni met with the daughter, who signed an affidavit of non-prosecution and desperately wanted to move back home with her mother. On the morning of the arraignment in District Court, Attorney Calcagni and his team successfully persuaded the judge and prosecution to dismiss this case. The matter was subsequently sealed, leaving the woman with no criminal history on her record.
