Obstruction of Police Officer in East Providence RI
Criminal Charge:
Man charged in the Rhode Island District Court (6th Division) for:
- Obstructing a Police Officer in Execution of Duty, in violation of R.I.G.L. § 11-32-1
Case Overview:
East Providence Police were on a routine patrol when they observed an erratic driver changing lanes and accelerating at different speeds. The vehicle also had a broken taillight. Police conducted a motor vehicle stop. They approached the vehicle and asked the operator for his license, registration, and insurance. He refused to provide them, even after being asked several times by the officer. The driver also refused to exit the vehicle when ordered to do so by police. Police forcefully removed the driver, placed him under arrest, and charged him in Rhode Island District Court (6th Division) with Obstructing a Police Officer in Execution of Duty. The man hired Rhode Island Criminal Defense Lawyer, John L. Calcagni III, and his team to defend him in this matter.
Case Result: 6-Month Filing.
As the case progressed, Attorney Calcagni and his team were able to convince the prosecutor to resolve the case with a filing for 6 months. Under Rhode Island law, a “filing” calls for acceptance of responsibility to the charged offense but does also does not result in any punishment or criminal conviction. Instead, the case is filed for the 6 months and providing the man does not get in any further trouble with the law during the filing period, the matter will be eligible for expungement at its conclusion, leaving the man with a clean record.
