- Indecent Exposure, in violation of R.I.G.L. § 11-45-2
City, State, County and Court:
North Kingstown, Rhode Island, Kent County
Rhode Island District Court (3rd Division)
Case Overview:
North Kingstown Police received a report of Indecent Exposure from a patron of a yoga studio. The woman claimed that after her yoga class and while walking to her car she observed a man seated alone inside a parked vehicle. She alleged that the man was masturbating in the car. She attempted to record him but was unsuccessful. However, she recorded the make, model, and license plate before the man fled the area. Police traced the vehicle to a rental agency, and through further investigation, identified the man to whom the vehicle had been rented at the time. Once police obtained the man’s license photo, the woman was asked to identify the photo as the man whom she had seen masturbating. Once she provided a positive identification, police obtained an arrest warrant for the man. Upon learning of the warrant, the man hired Rhode Island Sex Offense Defense Lawyer, John L. Calcagni III, to defend him in this matter.
Case Result: 90-Day Filing
Attorney Calcagni first coordinated his client’s voluntary surrender to police, and then, his release on bail. With the passage of time, Attorney Calcagni successfully negotiated for the resolution of this case with a 90-day filing. Providing the man does not reoffend within the filing period, the case will be eligible for expungement in 3 months, and he will not incur a criminal conviction from this experience.
