Warwick 1st Offense DUI Dismissed
Criminal Charges:
Woman charged in the Kent County Rhode Island District Court (3rd Division) for:
- Driving Under the Influence, BAC Unknown – 1st Offense, in violation of RIGL § 31-27-2
- Refusal to Submit to a Chemical Test, in violation of RIGL § 31-27-2.1
Case Overview:
Coventry Police conducted a traffic stop after observing the vehicle drive over a curb, sidewalk, and into the middle of a field. Police approached the vehicle, occupied by two individuals, and requested that they step out. Once outside, the officer immediately detected a strong odor of an alcoholic beverage emanating from both inside the car and the operator’s breath. Police also observed the woman to be very unsteady on her feet, her eyes to be bloodshot, watery, and glossy, and her speech to be slurred. When asked about her activities that evening, she admitted to consuming beverages earlier in the evening. She was then asked to perform the Standardized Field Sobriety Tests, which she declined to do. Police arrested the woman for suspicion of drunk driving and transported her back to the police station where she declined to participate in a chemical breath test. The police then charged her with the criminal misdemeanor offense of Driving Under the Influence in Rhode Island District Court and the civil offense of Refusal to Submit to a Chemical Breath Test and multiple traffic infractions in the Rhode Island Traffic Tribunal. She retained RI DUI Lawyer, John L. Calcagni III, to defend her in these matters.
Case Result: Dismissed.
After appearing on the woman’s behalf for multiple pretrial conferences, Attorney Calcagni and his team persuaded prosecutors to dismiss the client’s criminal charge in exchange for her acceptance of responsibility to the civil offenses in the Rhode Island Traffic Tribunal. The woman’s criminal DUI charge was then sealed, leaving her with a clean criminal history.
