Case Overview:
A young intoxicated woman had an altercation at home with her husband and father-in-law. Police responded and found the home in disarray, along with a broken ceiling fan on the floor and a shattered mirror. The father-in-law told the police that the woman became irate, ripped the fan from the ceiling, and smashed the mirror causing lacerations to both her leg and husband’s hand. Police observed both parties to be injured and bleeding. The woman’s husband told police that she struck him in the face repeatedly with a closed fist. Based on the men’s reports and observed damaged property, Burrillville Police arrested the woman for domestic violence charges including Domestic Assault, against her husband, Domestic Vandalism, for the damage caused to her father-in-law’s home, and Domestic Disorderly Conduct, for her overall behavior. The woman, a Rhode Island registered nurse, could not sustain any form of criminal conviction from this incident without experiencing adverse consequences to her nursing license. She retained Rhode Island Domestic Assault Defense Lawyer, John L. Calcagni III, to defend her in this matter.
Case Result:
Dismissed. Attorney Calcagni first advocated for the support of the woman’s husband and father-in-law in favor of a dismissal. He then successfully persuaded the Town Solicitor to dismiss this case and its charges. The case has since been closed and is eligible to be sealed under Rhode Island law.
