Arrested by the FBI and Charged with Multiple Drug Charges
Criminal Charges:
Man Arrested by Federal Bureau of Investigation and charged in United States District Court for the District of Connecticut for:
- Multiple counts of Possession with Intent to Distribute and Distribution of Fentanyl
- Possession with Intent to Distribute Fentanyl
- Possession with Intent to Distribute Cocaine
- Possession of a Firearm in Furtherance of a Drug Trafficking Crime; and Unlawful Possession of a Firearm by a Felon
Case Overview:
Federal law enforcement agencies performed a long term, undercover investigation into drug trafficking in the District of Connecticut. The target of the investigation was a man believed to be in the business of acquiring bulk quantities of cocaine and fentanyl and redistributing them in the area. Police conducted surveillance and several controlled buys from the man using a confidential source. They then applied for and obtained an arrest warrant for the man as well as a search warrant for his residence. They arrested the man without incident. A search of his home revealed a kilogram of cocaine, some fentanyl, drug trafficking paraphernalia and a loaded, unlicensed firearm. The man was indicted in U.S. District Court for the District of Connecticut with multiple counts of Possession with Intent to Distribute and Distribution of Fentanyl; Possession with Intent to Distribute Cocaine; Possession of a Firearm in Furtherance of a Drug Trafficking Crime; and, Unlawful Possession of a Firearm by a Felon. If convicted of these offenses, the man faced a mandatory minimum potential jail sentence of 10 years: 5 years for the drugs and 5 minimum and consecutive years for the gun. He retained Federal Criminal Defense Lawyer, John L. Calcagni III, to defend him in this complicated matter.
Case Result:
100 months of incarceration followed by 4 years of supervised release. After several months of negotiations, Attorney Calcagni successfully persuaded the government to dismiss all but one count of the indictment. He further negotiated a plea agreement that called for the man’s guilty plea to Possession with Intent to Distribute 40 Grams or More of Fentanyl and the criminal charge of Unlawful Possession of a Firearm by a Felon. In exchange for the guilty pleas, the man reduced his mandatory minimum exposure to 5 years. At sentencing, the Court calculated the man’s sentencing guidelines as being between 100 – 125 months based on a criminal history category of IV. Attorney Calcagni successfully persuaded the Court to impose a sentence of 100 months of incarceration followed by 4 years of supervised release.
