Arrested for Marijuana Possession in Coventry RI
Criminal Charges:
Man Arrested by Coventry Police and charged in Rhode Island District Court (3rd Division), Kent County, Warwick, RI and Rhode Island Superior Court, Kent County, Warwick, RI for Multiple Charges of Possession with Intent to Deliver Marijuana.
Case Overview:
Coventry Police conducted a motor vehicle stop for speeding. As the officer approached the vehicle, he smelled a strong odor of marijuana. The man operating the vehicle immediately told the officer that he has a Rhode Island Medical Marijuana Card. Officers asked the man to exit the car and searched inside where they found a backpack filled with various forms of marijuana. In the trunk of the SUV, they discovered a tote containing different types and forms of marijuana. From the vehicle, officers seized approximately 660 grams of loose marijuana, rolled marijuana cigarettes totaling 23 grams, 84 grams packaged in tins, 40 marijuana edibles, 30 marijuana extract oils and $9,819 in U.S. currency. The man was then arrested and charged with Possession with Intent to Deliver Marijuana. Police transported him to the station where he admitted to growing marijuana at his home in West Warwick. The man then signed a consent to search form allowing police to search inside. Members of the Coventry and West Warwick Police seized approximately four (4) pounds of marijuana, marijuana chocolates, 180 grams of marijuana shatter, 15 hydrochloride pills, and $34,541 in U.S. currency. The discoveries in the home led to additional felony marijuana trafficking charges. The man retained Rhode Island Marijuana Possession Lawyer, John L. Calcagni III, to defend him in this matter.
Case Result:
Five (5) years at the ACI all to be suspended with probation. Attorney John L. Calcagni III entered his appearance and secured the man’s release on bail. Attorney John L. Calcagni III then conducted discovery, obtained the evidence, and appeared for multiple pretrial conferences. He then began negotiating with the State in an effort to resolve the case with a pretrial disposition. Because the man had a prior felony record with other drug offenses, the State initially wanted jail time. Overtime, however, Attorney John L. Calcagni III successfully persuaded the State to resolve the case with a 5-year suspended sentence with probation.
