Assault and Battery Stemming from Road Rage: Dismissed
Police received a report of an assault and battery stemming from an incident of road rage in Taunton, Massachusetts. The victim told police he was driving on a one lane road with a tractor trailer truck in front of him that was traveling at a low rate of speed. The victim passed the truck on the left, parked in a nearby lot and proceeded to enter a building. He then noticed the tractor trailer truck pull behind him in the parking lot. The driver jumped out, approached him aggressively and began screaming. The driver then poked the victim in the chest multiple times, and in a fit of rage, kicked him in the genitals with his cowboy style work boots. The victim fell to the ground in pain and the driver ran off to his truck. Before he could escape, police arrived placed the driver under arrest for Assault and Battery with a Dangerous Weapon (i.e. shod foot). The man immediately retained Massachusetts Assault Defense Lawyer, John L. Calcagni III, to defend him. After obtaining and reviewing all of the evidence following extensive and ongoing negotiations with the District Attorney’s Office, Attorney Calcagni and his team successfully negotiated for the dismissal of this case.
