- Possession of One Ounce to One Kilogram of Cocaine, in violation of RIGL § 21-28-4.08 (A)(2)(b)
- Possession with Intent to Deliver Cocaine, in violation of RIGL § 21-28-4.02 (A)(2)(b)
- Conspiracy to Possess with Intent to Deliver Cocaine, in violation of RIGL § 11-1-6 and 21-28-4.08
Case Overview:
Glocester Police executed a search warrant of a local hotel room believed to be occupied by two long-term tenants. The two occupants, a man and a woman, were both from Connecticut and in a dating relationship. They had been staying together at the hotel for nearly one year. The hotel manager reported them to police after observing a pattern of suspicious activity by the couple, consistent with selling drugs from the premises. Upon executing a search warrant for the couple’s hotel room, police located approximately 240 grams of cocaine, combined of crack and powder forms, along with tools associated with drug trafficking such as digital scales, packaging materials, and cutting agents. Police also found a large amount of money and evidence the man and woman were also drug users, such as crack pipes and intravenous needles. Based on the discovery of drugs and related paraphernalia, police arrested the couple and charged them with various drug conspiracy and drug trafficking offenses in Rhode Island District Court. At arraignment, the Court ordered the couple to remain held without bail. Once detained, their friends and family hired Rhode Island Drug Defense Lawyer, John L. Calcagni III, to represent them in these serious matters.
Case Result: Bail Granted.
At a bail hearing, Attorney Calcagni and his team presented evidence of the couple’s longstanding history together and illicit drug abuse. Attorney Calcagni also presented proof that the woman, several months earlier, received a large personal injury settlement, which she had squandered almost completely on drugs. Based on the severity of the couple’s addictions, Attorney Calcagni and his team successfully persuaded prosecutors to agree to release the man and woman, each on surety bail, with conditions that they attend separate, residential substance abuse treatment programs. Attorney Calcagni and his team secured separate placements for the man and woman in such programs, thereby facilitating their release on bail.
