Caregiver’s Assault Charge Dismissed in Barrington, RI
Charge:
Individual charged in Rhode Island Superior Court (Providence County), Barrington, Rhode Island, Providence County for:
- Assault and Battery On Person Age 60 or Older, in violation of RIGL § 11-5-10.3
Case Overview:
Police were dispatched to a nursing home following a report that a caregiver employed by the home assaulted a disabled patient. Police interviewed various employees of the home who were present inside the patient’s room while he was receiving care from the worker in question. The witnesses heard a sound consistent with a slap, causing them to turn around and see the caretaker standing directly in front of the patient. Contemporaneous with the sound, they also heard the caretaker scream to the patient “do not touch me” or words to that effect. The disabled patient was not vocal, and therefore, unable to speak or provide police with a statement. The caregiver declined to speak with police. He was terminated from his employment that day, and arrested for Assault and Battery on a Person Age 60 or Older. This felony charge was informed or filed against him in Rhode Island Superior Court. The man retained Rhode Island Assault Charges Defense Lawyer, John L. Calcagni III, to defend him in this matter.
Case Result: Dismissed.
