Charged with possession with intent to deliver marijuana in Rhode Island
A Connecticut man was arrested in Newport, Rhode Island while in possession of 10 pounds of marijuana. Newport Police arrested the man as part of an undercover narcotics investigation. While working in an undercover capacity, police used the phone of a previously arrested drug trafficker to order the marijuana. The Connecticut man then traveled to Newport to make the delivery, as police had hoped. They stopped his vehicle and inside, discovered the large quantity of marijuana. The man was initially charged with possession with intent to deliver marijuana in Rhode Island District Court (Newport County) and held without bail. He retained Rhode Island Drug Defense Lawyer, John L. Calcagni III, to defend him in this matter. Attorney Calcagni prepared for the Court a bail package describing in detail his client’s lack of criminal history, strong family support, children for whom he had joint custody, employment, enrollment in barber school, and cooperation with police. Based on these efforts, Attorney Calcagni successfully persuaded the judge, over the State’s objection, to release the man on bail. Once the man was formally charged in Rhode Island Superior Court (Newport County), Attorney Calcagni continued to represent him there by successfully fighting to keep his client on bail and thereafter, persuaded the judge, again over the State’s objection, to resolve the case with straight probation.
