An Albanian man burglarized a Target Department Store in Smithfield, RI. After cutting a hole in the store roof and gaining entry by lowering himself with a rope, the man broke into and removed $14,720.00 from an automated teller machine (ATM) on the premises. He also broke into a satellite CVS Pharmacy, also on the premises, and stole Oxycodone pills and other prescription medications. A silent alarm notified Smithfield Police of the break-in. Upon arrival, police discovered the man hiding inside an HVAC unit located on the rooftop.
Smithfield Police arrested the man and charged him with multiple felonies. Federal prosecutors from the U.S. Attorney’s Office later picked up the case and charged the man with Conspiracy to Commit Larceny from a Financial Institution, Bank Larceny, Conspiracy to Commit Burglary Involving Controlled Substances and Burglary Involving Controlled Substances.
The man retained Federal Criminal Defense Lawyer, John L. Calcagni III, to defend him in this matter. Attorney Calcagni negotiated a pretrial agreement on the man’s behalf and then appeared with him for sentencing. Based on his limited criminal history, imminent deportation, and substance abuse addiction that motivated the crimes, Attorney Calcagni successfully persuaded the Court to impose a sentence of time served, or ten months, for the man’s actions.
