Cumberland RI Stalking Case Resolved with Suspended Sentence
Criminal Charges:
Man charged in the Rhode Island Superior Court (Providence County) for:
- Stalking, in violation of R.I.G.L. § 11-5-2
- Bail Violation
Case Overview:
Cumberland Police received a report of an incident of harassment and stalking involving two neighbors. A female alleged that her male neighbor just would not leave her alone, through his continuance and unwanted calls, text messages, and uninvited visits to her home. The was also seen walking and pacing back and forth in front of the woman’s residence (where she resided with her husband and children), talking loudly, taking pictures, and occasionally driving by while sounding the horn. Based on this information, the man was subsequently arrested and charged with felony Stalking in Rhode Island Superior Court. The man retained Rhode Island Criminal Defense Lawyer, John L. Calcagni III, and his team to defend him in this matter.
Case Result: 5-Years Suspended Sentence with Probation.
Attorney Calcagni reviewed the facts of the case and conferenced the matter with the prosecutor. Attorney Calcagni began working on mitigation materials to dispute the facts and raise a valid defense for the man’s conduct. Unfortunately, while the man was released on bail, he was arrested again for the same conduct involving the same victim. Due to this new charge, which triggered a bail violation, Attorney Calcagni and his team negotiated an agreeable resolution of the two felony Stalking cases that enabled the man to avoid jail, but resulted in a sentence of probation.
