Case Overview:
Coventry Police responded to a report of domestic violence. Upon arrival, they spoke with a female who stated that she and her husband got into a verbal argument. She further stated her husband spit in her face and pushed her. As she tried to leave, the man would not let her out of the home and took hold of her cellphone so she could not call the police. She was finally able to escape and came to the neighbor’s house to call the police. Officers then spoke with the husband who stated that he and his wife got into an argument but that she was the one who spit in his face and had hit him on the neck. The man also denied pushing the woman, spitting at her, or preventing her from leaving their home. Police then spoke with the couple’s children who stated that their parents got into an argument and the mother spit in the father’s face. The children also stated they did not see their father strike or hit their mother. Notwithstanding the children’s account of events, police still arrested and charged the man with Domestic Simple Assault and/or Battery, Domestic Disorderly Conduct and Domestic Refusal to Relinquish Telephone in Rhode Island District Court (3rd Division). He hired Rhode Island Criminal Defense Lawyer, John L. Calcagni III, to defend him in this matter.
Case Result: Dismissed.
The man had no criminal record and had been with his wife for several years. As the case progressed, Attorney Calcagni and his team successfully persuaded the prosecution to dismiss this case. The case was subsequently sealed, leaving the man with a clean criminal history.
