Domestic Assault and Vandalism Charges Dismissed in Providence RI Court
Criminal Charges:
Man charged in Rhode Island District Court (6th Division), Providence County for:
- Domestic Simple Assault and Battery, in violation of R.I.G.L. § 11-5-3(a)
- Domestic Disorderly Conduct, in violation of RI.G.L. § 11-45-1(a)
- Domestic Vandalism, in violation of R.I.G.L. § 11-44-1
Case Overview:
Providence Police were dispatched for a 9-1-1 call hang up. Upon arrival, police were met with the woman who made the call. The woman said she heard a loud noise coming from outside her apartment window. When she looked outside, she observed her neighbor trying to break a window to his basement apartment and physically struggling with his girlfriend. Police then met with the female victim who admitted she and the male were arguing, but denied knowledge about how she sustained visible injuries to her face and neck. Police met with her boyfriend who denied any wrongdoing, and also had visible injuries. Based upon the totality of the circumstances, the man was arrested and charged with Domestic Simple Assault, Domestic Disorderly Conduct, and Domestic Vandalism. He retained Rhode Island Domestic Violence Defense Attorney, John L. Calcagni III, to defend him in this matter.
Case Result: Dismissed.
After several pretrial conferences, the prosecutor was unwilling to dismiss the case and Attorney Calcagni placed the matter down for a trial. On the day of trial, unable to meet the burden of proof and the prosecutor moved to dismiss the case.
