Felony Assault: Dismissed
A young woman was criminally charged with felony assault or assault with a dangerous weapon following her involvement in an altercation with another female at a house party. A male friend in common to the two women hosted the party. There were many people in attendance. The woman initially became involved in a verbal altercation with the second female. The altercation became heated and prompted the young woman and her boyfriend, with whom she had attended the party, to leave.
On their way out, the woman picked up a beer bottle and threw it at the other girl, striking her in the face and nose. The woman then fled the party and never returned. The victim called the police to report this assault. She also received medical attention for her injuries.
As a result, the woman was criminally charged approximately one year later after learning of a warrant for her arrest. She and her family retained Rhode Island Criminal Defense Lawyer, John L. Calcagni III, to defend her in this matter. After conducting his own investigation and developing mitigating evidence of his client’s background, education, employment as a healthcare professional and lack of criminal history, Attorney Calcagni successfully persuaded the prosecution to dismiss this case. The matter has since been sealed from the woman’s history and erased from public record.
