Case Overview:
A Citizen of Boliva with aspirations of United States Citizenship had an altercation with his ex-girlfriend in the hallway of his apartment complex. A friend of the ex-girlfriend claimed to have seen the assault and called the police. The man was accused of grabbing the woman by her hair and neck and slamming her head into the wall. The woman also stated that he choked her causing her to lose consciousness. As a result of the observations by the neighbor, physical marks on the woman, and the statement by the ex-girlfriend, the man was arrested and charged in Rhode Island Superior Court with Domestic Felony Assault, Domestic Assault by Strangulation, and Domestic Simple Assault. If found guilty of this offense, the man would most certainly serve time in jail and encounter adverse immigration consequences. He retained Rhode Island Criminal Defense Lawyer, John L. Calcagni III, to defend him against these serious charges.
Case Result: Suspended Sentence on the Amended Charge of Domestic Willful Trespass.
After a passage of time and with other mitigation, Attorney Calcagni and his team successfully persuaded prosecutors to amend the domestic felony charges to a domestic misdemeanor offense of willful trespass. In exchange for the man’s admission to this less serious offense, he received a one-year suspended sentence. Most importantly, he both avoided spending any time in jail and is not expected to suffer any adverse immigration consequences because of this case disposition.
