Johnston RI Cocaine Distribution Case: Successful Bail Negotiation
Criminal Charges:
Johnston resident charged in the Rhode Island Superior Court (Providence County) for:
- Possession with Intent to Sell Cocaine 1oz to 1kg, in violation of R.I.G.L. § 21-28-4.01.1(a)(2)(ii)
- Possession with Intent to Deliver Cocaine, in violation of R.I.G.L. § 21-28-4.01(a)(4)(i)
Case Overview:
Rhode Island State Police began an investigation into a narcotics overdose resulting in death. Throughout the investigation, the police seized the victim’s cellphone and was able to retrieve information on the dealer who possibly gave her tainted drugs. Police conducted surveillance of the man’s home and searched his trash, which yielded several items that tested positive for cocaine as well as was indicative of drug distribution. Police then used the victim’s cellphone to conduct a controlled buy with the man. The man responded to the predetermined location and sold cocaine to an undercover officer. In response, the man was arrested and charged with Possession with Intent to Sell Cocaine 1oz to 1kg and Possession with Intent to Deliver Cocaine. Case Result: Bail Granted.
The man was arraigned and subsequently held without bail pending an evidentiary hearing. Attorney Calcagni immediately filed his appearance and began negotiating with the State prosecutor for the man’s release on bail. He outlined the man’s lack of criminal history, family and community ties, residential history, U.S. Citizenship, cooperation with authorities regarding his own conduct, along with his own addiction and use of the same drugs distributed to his customers. After several conferences, Attorney Calcagni persuaded the Court to release the man on $75,000 surety bail with conditions. This was over the objection of state prosecutors.
