Kingston RI Indecent Exposure Charge Settled with 1-Year Filing
Criminal Charges:
Massachusetts resident charged in Rhode Island District Court (4th Division), Washington County for:
- Indecent Exposure, in violation of R.I.G.L. § 11-45-2
Case Overview:
Amtrak Police notified local authorities of a passenger who exposed himself to masturbate on a train. The man was observed by another passenger sitting in an adjacent seat. She observed the man sitting alone, remove his penis, and begin to masturbate completely out in the open. She immediately notified the conductor who removed the man from the train at the Kingston, RI train stop. Narragansett Police investigated this incident and identified the man with the assistance of Amtrak Police and surveillance footage provided by the railroad. Narragansett Police located the man, a Massachusetts resident, and caused a warrant to issue for his arrest. He was arrested on the warrant in Massachusetts and initially detained without bail there pending his extradition to Rhode Island. The man’s family hired Rhode Island Sex Offense Defense Lawyer, John L. Calcagni III, to defend him in this matter.
Case Result: 1-Year Filing.
The man needed very experienced representation, as he was on probation in the Commonwealth for the same type of misconduct. Attorney Calcagni entered the case in Rhode Island District Court and secured his client’s release on bail. He then facilitated placing the man into counseling with a provider who specializes in treating individuals with psychological disorders that are of a sexual nature. With the passage of time, Attorney Calcagni successfully negotiated for the resolution of this case with a one-year filing. Providing the man continues with his counseling and does not reoffend within the filing period, the case will be eligible for expungement in 12 months, and he will not incur a criminal conviction from this experience.
