Massachusetts Gun and Drug Charges: Dismissed After Motion to Suppress Evidence.
Police stopped a motorist for speeding. They then detected an odor of marijuana coming from inside the vehicle during interactions with the driver. Based on the odor of marijuana, police asked the man for consent or permission to search his car. The man agreed. Police removed the man from the car and during a search of the trunk, discovered a loaded .45 caliber handgun and a quantity of marijuana. Based on these discoveries, police arrested the man for Massachusetts gun and drug charges. The man retained Massachusetts Criminal Defense Lawyer, John L. Calcagni III, to defend him. Attorney Calcagni defended the case by filing a motion to suppress. The motion alleged that police unlawfully prolonged the man’s traffic stop, and as a result, obtained illegal consent to search his car. After hearing, the Court granted Attorney Calcagni’s motion, which resulted in the dismissal of this case and its charges.
