Multiple Charges and Criminal Complaint Applications for Assault: Dismissed
A wife, who is a mother of five and a registered nurse, was arrested and charged in Fall River District Court with Assault and Battery on a Household Member. Her soon-to-be ex-husband was the named victim.
In retaliation for this event and the impending divorce, the couple’s second oldest son filed private applications for criminal complaints, alleging assault, against his mother and older brother, who had sided with their mom during initial incident. The wife retained Massachusetts Criminal Defense Lawyer, John L. Calcagni III, to defend her in this matter.
Attorney Calcagni and his team came to the woman’s defense. They first appeared with the woman in Fall River District Court and successfully persuaded the Court and District Attorney’s Office to dismiss the criminal complaint against her, which was based solely on her scored husband’s allegations.
Attorney Calcagni and his team next appeared with the woman for two separate Clerk-Magistrate Hearings, where they successfully defeated two separate applications for criminal complaints, which were summarily denied.
