Case Overview:
North Smithfield Police received a walk-in complaint by a juvenile alleging that another juvenile was in possession of possible child pornography. Police contacted the juvenile’s parents and requested that he come to the station to be questioned. The parents brought the juvenile to the station where the police seized his electronic device. Upon review of the juvenile’s phone, police observed hundreds of images and videos which appeared to meet the definition of child pornography. The young boy was arrested and charged in Providence County Juvenile Court with Possession of Child Pornography. Once arrested and charged, the man retained Rhode Island Sex Crime Defense Lawyer, John L. Calcagni III, and his firm, to defend him in this matter.
Case Result: Probation.
Attorney Calcagni and his firm began working immediately to secure the young man’s release on bail and order a psychosexual evaluation to determine his odds of reoffending. After several pretrial conferences and conversations with the Court and over the State’s objection, Attorney Calcagni and his team successfully negotiated a plea agreement that called for the State to amend or reduce the sex-offense felony of possessing child pornography to the non-sex offense felony of fraudulently using a computer. In exchange for the young man’s admission to this reduced offense, the Court sentenced him to probation until completion of the court-ordered sex offender counseling. This sentence spared the juvenile from the risks of both jail and sex offender registration.
