Pawtucket RI First Degree Sexual Assault Case

Case Overview:
Pawtucket Police investigated a young Attleboro woman for First Degree Sex Assault. The woman met a 17-year-old male using a dating mobile application. After making the connection, the woman traveled to Pawtucket, Rhode Island on multiple occasions to spend time with the young man. The two drove around, went out to eat, smoked marijuana, went to the park, and allegedly engaged in sexual contact. The boy lied to the woman about his age. The woman learned the boy’s true age when his mother contacted her to inform her, and also to direct that she stays away from her son. The woman followed this advice, despite the boy still texting and asking to see her “one more time.” The woman never accepted the invitation, but some weeks later, she was contacted by Pawtucket Police who informed her the boy was autistic, had the intelligence of a 10-year-old, and had accused her of forcing him to allow her to perform oral sex on him. Based on the boy’s allegation, as reported to police by his mother, Pawtucket Police obtained an arrest warrant for the woman based on First Degree Sexual Assault. Case Result: Bail Granted
Attorney Calcagni coordinated the voluntarily surrender of his client to authorities on the warrant. He then appeared with her for arraignment in Rhode Island District Court where she faced the possibility of being ordered held without bail. Attorney Calcagni spent an entire morning persuading prosecutors his client was not a flight risk, had no record, was a single, employed mother, and was innocent of the charges alleged by a complainant who was still trying to contact her, even against his mother’s wishes. Based on Attorney Calcagni’s tireless efforts, he ultimately convinced the prosecutors to agree to the woman’s release on bail. She was released on $50,000 surety bail, with conditions that she waive extradition and have absolutely no contact with the complainant.
