Rhode Island District Court (3rd Division)
Case Overview:
Two men were involved in a minor automobile accident, when their vehicles collided on a busy roadway. The party at fault failed to immediately stop, and drove away. The man whose vehicle had been struck pursued him. Their vehicle came to a stop approximately one mile away. Both men exited their vehicles. The at fault man approached the aggrieved man in an aggressive fashion. The aggrieved man responded by grabbing the other man by the collar of his jacket, and holding him in place to avoid any further altercation or flight. A police officer who was nearby working a detail quickly arrived on scene and arrested the physical aggressor, though he was the party aggrieved by the hit and run. He was subsequently charged in Rhode Island District Court (3rd Division) with Simple Assault and Disorderly Conduct. He immediately hired Rhode Island Criminal Defense Lawyer, John L. Calcagni III, to defend him in this matter.
Case Result: Case Dismissed.
After several pretrial conferences, Attorney Calcagni successfully persuaded prosecutors to dismiss this case and its charges based on several facts including his client’s self-defense claim to the at fault party’s aggressive approach and completion of a short anger management course. This case is now eligible to be sealed from public record.
