Case Overview:
Woonsocket Police initiated a criminal investigation into allegations of First-Degree Sexual Assault by a young man against his former girlfriend. The couple had been dating for approximately 10 months. The relationship was sexual in nature. In one instance, after commencing consensual sexual relations, the girl alleged that she told her boyfriend to stop, and he refused. This prompted her to notify police. Upon learning of the investigation, the man smartly retained Rhode Island Sex Assault Criminal Defense Lawyer, John L. Calcagni III, to defend him in this matter.
Case Result: Investigation Closed with No Criminal Charges
Attorney Calcagni advised the man of his legal rights to counsel and against self-incrimination and educated him on the process of sex assault investigations and criminal prosecutions. Attorney Calcagni also sent a notice of representation letter to police informing investigators that the man was represented by counsel and should not be contacted by law enforcement agents under any circumstances. Attorney Calcagni also reminded police of the man’s strong consent defense and complete lack of evidence to support the woman’s rape claim. As time passed, police sided with the Defense by concluding there was insufficient evidence to warrant criminal prosecution. Woonsocket Police closed its investigation without filing any criminal charges.
