Case Overview:
A young woman had an altercation with her father. Middletown Police responded to the domestic disturbance. Upon arrival, police met the father and his wife, the girl’s stepmother. The father stated that his daughter assaulted him and vandalized his vehicle before taking off on foot. Police began searching for the woman based on the information from her father and once found, arrested her and charged her with Domestic Simple Assault and/or Battery and Domestic Vandalism. Due to the woman’s pending case in Newport, where she was released on bail conditions, the new offense violated her bail and she was detained. Filing for 1 year. Attorney Calcagni first successfully advocated for reinstatement of the woman’s bail. Attorney Calcagni then advocated for the support of the woman’s father and mother-in-law in favor of a dismissal. He then successfully persuaded the Town Solicitor for Middletown to dismiss its case and its charges in exchange for an admission to an amended charge of non-domestic disorderly conduct in the woman’s Newport matter to be filed for one (1) year with conditions. The matter will be eligible for expungement at its conclusion of the 1 (one) year filing.
