Woonsocket Man Sentenced to 30 Months for Drug and Gun Charges
Criminal Charges:
Man charged in Rhode Island Superior Court (Providence County) for:
- Possession with Intent to Deliver 1 Ounce to 1 Kilogram of Cocaine, in violation of RIGL § 21-28-4.01.1 (a)(2)(ii)
- Possession of a Firearm by a Prohibited Person, in violation of RIGL § 11-47-5 (a)(1)
Case Overview:
Woonsocket Police investigated a local man for cocaine trafficking. After making several controlled drug purchases from the man using a confidential informant, police obtained a search warrant for the apartment the man shared with his girlfriend and small children. Upon executing the warrant, police discovered and seized a 9mm handgun, approximately 42 grams of crack cocaine, 18 grams of fentanyl, and more than $25,000 in cash. The man was arrested on felony drug and gun charges. He was also on Superior Court probation in several prior felony drug trafficking cases, where he faced more than 10 years on various suspended sentences. This man hired Rhode Island Criminal Defense Lawyer, John L. Calcagni III, to defend him in this matter and related probation violations.
Case Result:30 Months in Jail Followed by Suspended Sentence with Probation.
Attorney Calcagni prepared a memorandum of law, outlining legal arguments attacking the warrant that police relied upon to search the man’s apartment. Based on this memorandum and other mitigation information offered to the prosecution by the Defense, Attorney Calcagni and his team negotiated a resolution of both the new charge and resulting probation violations that called for the man to serve 30 months in jail, followed by a suspended sentence with probation. The existing probation cases were also left intact, with no added punishment for the various probation violations triggered by the new felony charges.
