Fifth-degree arson charges in Rhode Island
Under Rhode Island Criminal law, Fifth-Degree Arson may be found under Rhode Island General Laws, Section 11-4-6. This offense penalizes the conduct of knowingly and intentionally attempting, by means of fire or explosion, to cause, procure, aid or counsel the damage or destruction of any property which it may be unlawful to set fire to listed in First, Second, Third, Fourth-Degree Arson offenses.

Legal elements of fifth-degree arson
In order to be convicted of Fifth Degree Arson, there must exist strong evidence of the following legal elements:
- that the defendant caused, procured, aided, counseled the damage or destruction of any property
- that the defendant did so by means of fire or explosion
- the defendant did so knowingly and intentionally
- that property was the type listed in First, Second, Third, or Fourth-Degree Arson
Potential punishment if convicted of fifth degree arson in Rhode Island
Under Rhode Island criminal law, a conviction for Fifth Degree Arson is a felony. Convicted defendants shall be sentenced to imprisonment for not less than one (1) years nor more than twenty (20) years. This penalty may be found at Rhode Island General Laws, Section 11-4-6.
