Understanding Rhode Island Laws on Domestic Strangulation
Under Rhode Island Criminal Law, Domestic Strangulation is outlawed by Rhode Island General Laws, Section 11-5-2.3. Strangulation is defined as knowingly and intentionally impeding normal breathing or circulation of the blood by applying pressure on the throat or neck or by blocking the nose or mouth of another person, with the intent to cause that person harm. This is considered a felony crime in Rhode Island, with a maximum possible punishment of up to ten (10) years in jail.
How Strangulation Occurs and Its Impact
Strangulation occurs by the constant application of pressure on the neck, causing the victim to be deprived of oxygen from the forced closure of blood vessels and air passages. Strangulation may lead to death or serious bodily injury, depending on the amount of pressure applied to the victim’s neck and the duration of such pressure. The prolonged restriction of oxygen leads to unconsciousness. The amount of force needed to cause injury or death varies from person to person. The risk of injury is great, which is why this felony offense comes with a heavy penalty for convicted offenders.
Four Types of Strangulation
- Hanging Strangulation
Occurs where the body is suspended in some way, such as with a rope or other ligature. - Ligature Strangulation
Happens when the assailant applies pressure to the victim’s neck using a ligature such as rope, twine, wire, belt, strap, or article of clothing. - Manual Strangulation
involves the assailant applying pressure to the victim’s neck using hands, feet, legs, arms, or another body part. - Postural Strangulation
Entails placing the neck over or against an object and thereafter using body weight to apply the necessary pressure to restrict the airway.
Regardless of the manner, strangulation is dangerous and can lead to death or temporary unconsciousness.
